Long-serving Waitakere mayor now a knight

Former Waitakere Mayor Bob Harvey says his knighthood is a reflection of a political career as an "action man".

Sir Bob, 70, was given a knighthood on Monday for his services to local body affairs and the community after serving 18 years as mayor of the west Auckland council of Waitakere from 1992 to 2010.

Sir Bob, who has also been involved with Surf Life Saving New Zealand for 58 years, said he was deeply moved by the knighthood, which he said reflected the work of many other people but also his attitude that things can be changed.

"Whether it be lifesaving or the work I've done in the community, I've said `hey this is a big issue, and we can actually do something about it'," he said.

"So I'm a bit of an action man. I don't go and talk about it, I actually go and do things."

He said he got into politics after a successful career in advertising to improve the "wild west" image of west Auckland, where he grew up.

During his time as Mayor Sir Bob focused strongly on environmental issues, and said the greatest environmental achievement while he was Mayor was successfully promoting a Parliamentary law protecting the Waitakere Ranges and its foothills from development.

"But I'm really conscious that so many other people help you with these achievements. That bill was 40 years in the making - I just got it over the line."

Sir Bob was also president of the Labour Party from 1999 to 2000 and has been deputy chairman of the New Zealand Film Commission and a board member of Te Papa.

He is now chairman of Waterfront Auckland, a council-controlled organisation responsible for revitalising the central city waterfront.

"I feel that the creation of a headland park in our lifetime is something that all Aucklanders want, where the Tank Farm is now, so I'm going to give that a bit of a nudge next year."

Grover Norquist can act however he wants, but the facts are what they are. Denial, being more than the large African river that it is, doesn?t change those facts simply because they?re inconvenient for Republicans.

In the Senate, Democrats expanded their majority, and in the House they added seats to their minority. The only real strategy left to Republicans is to obstruct, oppose, and then blame the gridlock on the President?s intransigence. By acting as if the President is the only one charged with the responsibility of leading, Republicans can sit back and do- well, nothing. Rather than work to make America a better place for Americans, Congressional Republicans are primarily concerned with ensuring that nothing happens. That way they can blame the President for ?intransigence,? ?failure to lead,? or ?not bargaining in good faith?- which, if Republicans possessed any degree of self-awareness, would be things they should be admitting to.

For that matter, there?s overwhelming polling evidence that the American mainstream agrees with Democrats and supports a policy agenda in line with Democratic proposals. It?s why nearly all surveys say voters will blame the GOP is a fiscal agreement isn?t reached in time.

Republicans aren?t stupid. They know what the numbers are, and they understand their untenable position. Nonetheless, they?re determined to, if not win, then to at least gum things up for as long as they possibly can. That their strategy reveals them to be devoid of vision, compassion, and willingness to compromise seems lost on them. Since the Supreme Court?s 2010 Bilski ruling, the Federal Circuit has been consistent on only one point in its ? 101 jurisprudence?and that?s on being inconsistent. In the face of the Federal Circuit?s failure to provide a workable ? 101 standard, the Supreme Court issued its unanimous ruling in Mayo v. Prometheus, essentially telling the Federal Circuit to take the patentable subject matter inquiry seriously. Yet the Federal Circuit paid no heed when it issued ruled in CLS Bank v. Alice, all but ignoring the Supreme Court (for many of us court watchers, the Federal Circuit?s failure to address Mayo was shocking; even Judge Prost, in her dissent, admonished the majority for ?fail[ing] to follow the Supreme Court?s instructions?not just in its holding, but more importantly in its approach.?).

So it really was no surprise when the Federal Circuit agreed to take CLS en banc. We, along with many others, hope that this case would provide the Court an opportunity to head the Bilski Court?s warning that:

The Information Age empowers people with new capacities to perform statistical analyses and mathematical calculations with a speed and sophistication that enable the design of protocols for more efficient performance of a vast number of business tasks. If a high enough bar is not set when considering patent applications of this sort, patent examiners and courts could be flooded with claims that would put a chill on creative endeavor and dynamic change. (130 S. Ct. at 3229).

As currently interpreted, ? 101 leaves parties unable to discern a patent?s metes and bounds or assess its validity, making inadvertent infringement an unfortunate cost of doing business. This has led to a dangerous and dramatic increase in patent litigation, particularly surrounding business method patents or those covering software. For better or worse (and I think worse), the major uptick in these cases involved non-practicing entities. Some data that we included in our amicus brief filed in CLS Bank:

  • From 200-2002, NPE litigation accounting for only about five percent of patent litigation;[1] in 2007 that figure was 22 percent and in 2011 it was 40 percent.[2]
  • Litigation surrounding software patents has also greatly increased:

  • For the first time in 2011, spending by both Apple and Google on patents exceeded the firms? spending on new product research and development.[4]
  • NPEs now disproportionately target small companies; at least 55% of unique defendants sued by NPEs make under $10 million a year.[5]

These statistics are a direct result of the legal instability surrounding ? 101. One way to stem this problem is to create incentives for those facing litigation (or litigation threats) to pursue their meritorious defenses of noninfringement and invalidity. Section 101 could play that role, in fact, the Mayo Court seemed to state as much: ?to shift the patent-eligibility inquiry entirely to these late sections [??102, 103, 112] risks creating significantly greater legal uncertainty, while assuming that those sections can do work that they are not equipped to do.? 132 S. Ct. at 1304.

?Yet no version of recent ? 101 jurisprudence offers much hope of settling the law. Instead, we recommended in our brief (filed along with Public Knowledge) that the Federal Circuit take another route and adopt a stricter construction of ? 112(f), as recently proposed by Prof. Mark Lemley. Specifically, instead of attempting to figure out whether a broad, functional claim is abstract or not, a court may first use ? 112(f) to narrow the claim to the structures and their equivalents recited in the patent and then, if questions remain, make a ? 101 inquiry. ?

?While ? 112(f) has traditionally been applied to apparatus claims, it?s clear that Congress intended it to apply to method claims as well. Despite this, software patents often do not detail actual algorithms or explain how to actually carry out the methods they attempt to claim; as such they should be indefinite under cases like Aristocrat Techs. v. Int?l Game Tech. If the claims do specify the algorithms, then the ? 101 inquiry will be limited to those algorithms and their equivalents. These questions?of whether ?112(f) applies; if it does, how the claims should be limited; and then if ? 101 permits that narrowed claim?could all be accomplished at early stages of litigation, before expensive discovery and motion practice.

So the number is ultimately driven by a percentage of the cap, not by what the highest-paid players at each position make.? Eventually, the franchise tags will settle in as a fixed percentage of the salary cap, remaining the same each year and only rising based on how much the cap rises.

For some players, the tag becomes higher because the franchise tag rules guarantee the greater of the standard tag or 120 percent of the player?s cap number from the prior year.

Top 2012 Posts: New Homes are Less Expensive to Maintain ? Eye ...

With the end of 2012 approaching, we here at NAHB?s Eye on Housing thought we would take a look at the updates that attracted the most readers over the last year.? In April, we took a look at the cost advantages of new homes.

April is new homes month. And one of the virtues of a newly constructed home is the savings that come from reduced energy and maintenance expenses.

Data from the 2009 American Housing Survey (AHS) offer proof. The AHS classifies new construction as homes no more than four years old.

For example, for routine maintenance expenses, 26% of all homeowners spent $100 or more a month on various upkeep costs. However, only 11%? of owners of newly constructed homes spent this amount. In fact, 73% of new homeowners spent less than $25 a month on routine maintenance costs.

Similar findings are available for energy expenses. On a median?per square foot basis, homeowners spent 78 cents per square foot per year on electricity. Owners of new homes spent 65 cents per square foot per year.

For homes with piped gas, homeowners spent on average 53 cents per square foot per year. Owners of new homes spent 38 cents per square foot per year.

These data highlight that a new home offers savings over the life of ownership due to reduced operating costs. This is one of the many reasons that the current system of appraisals needs updating to reflect the flow of benefits that come from features in a new home.

In passport kerfuffle, Taiwan is stickin' it to China

Taiwan is fighting back with stickers after China issued passports showing ownership over the entire South China Sea.

China hasn?t started a military war with Taiwan ? as has been feared since the 1940s ? but a battle that began on paper last month has met with a fiery pulp-and-ink response that could burn a hole in goodwill between the two once-hostile governments.

Pictures on Beijing?s latest passports show a map of China that includes two parts of Taiwan, including its scenic showpiece Sun Moon Lake. The travel documents also depict islets in the South China Sea as China's, despite competing claims by Taiwan and several Southeast Asian countries.

China, already a regional heavyweight, is believed to have issued 5 million of the passports between April and November when they inflamed a regional dispute with neighbors. Now Taiwan is joining the chorus of protest, not by refusing to stamp them as Vietnam has announced it is doing, and not by issuing their own maps as India has done, but with some provocative stickers with a message to China. ?

China has claimed Taiwan as part of its turf since the 1940s, when Chiang Kai-shek?s Nationalists set up a government to rival mainland China's about 100 miles offshore after losing the Chinese civil war to Mao Zedong?s Communists. The relationship between China and Taiwan has been up and down for the past few decades: Both?formal reunification with the mainland and full Taiwanese independence have been suggested,?but a tempering of relations has kept many content with the middle ground status quo, with Taiwan considering itself an effectively independent territory.?

Still, the maps in China?s passports were taken as a bold affront to that. In response, Taiwan?s main opposition Democratic Progressive Party gave away 10,000 pink stickers at the foreign ministry consular office in Taipei. The stickers that read ?Taiwan is my Country? can be slapped onto the back cover of a Taiwan passport or onto a plastic passport protector.?

The stickers went fast two weeks ago, so the party copied off another 20,000. ?People just love them,? says its policy coordination executive director Joseph Wu. ?It?s quite clear that what China is doing trespasses into our sovereignty. Taiwan is not under any country?s jurisdiction.?

Across town, the smaller Taiwan Solidarity Union Party printed out oversized paper effigies of the Chinese passports and marred or burned them at a rally, according to local media.

Taiwan and China have set aside differences over sovereignty since 2008, when the island?s conciliatory President Ma Ying-jeou took office. Mr. Ma?s government has signed 18 deals with China, drawing Taiwan closer to the world economic powerhouse. Talks on those agreements built mutual trust that didn?t exist before.

The island?s foreign ministry says?that trust is now being questioned. The ministry?s news release calls China?s passport issue ?a provocative act that will ? damage the mutual trust laboriously built by the two sides in recent years.?

Taiwanese opposition forces are protesting the Chinese passports because they worry that the government is courting China rather than standing up to it, but analysts say officials in Taipei are just as irked as their skeptics.

?Our government thinks that China betrayed common ground, which is that there?s one China but subject to different interpretations,? says Nathan Liu, an associate international affairs professor at Ming Chuan University in Taiwan, citing the basis for talks and deals since 2008.

Calgary widow's videos offer glimpse into diabetes epidemic (with ...

CALGARY ? On the night of Sept. 15, 2012, Jim and Judy Wilkie were having a rare disagreement.

?He wanted to stay,? says the 62-year-old Calgary native. ?He was in a lot of pain and I knew he was only hanging on for me.?

The next evening, Wilkie?s husband of 44 years closed his eyes for the last time, his passing a peaceful conclusion to years of severe discomfort and deterioration from the myriad complications that can accompany Type 2 diabetes.

Before he died, though, Jim had made sure he left a legacy for the world, one in which he gave a graphic, no-holds-barred depiction of what it was like to live, and die, with the disease. With the help of his wife, who videotaped their sessions together, the two created hours worth of video so that others might learn from his ordeal.

?Diabetes is an epidemic, there are many more families that will find themselves in our situation,? says Wilkie of Type 2 diabetes, which currently afflicts more than three million Canadians, a number expected to rise to 3.7 million by 2020. ?Someone has to speak up about what it?s like to go through this.?

Type 1 diabetes, most commonly diagnosed in people before age 30, is due to the pancreas not being able to produce insulin. It is not preventable, and its cause is still unknown.

Type 2 diabetes, on the other hand, is largely blamed on a sedentary lifestyle, bad nutrition and smoking. Numerous studies have shown that by increasing physical activity, keeping a healthy weight and eating well, many of the symptoms can either be prevented entirely or managed.

The explosion in obesity rates in North America have resulted in more than 26 million people, an increasing number of them under the age of 45, being diagnosed with Type 2 Diabetes.

Jim Wilkie wasn?t obese; he didn?t smoke and rarely drank alcohol. What the nearly 20-year employee of the Coca-Cola Company?s Calgary bottling plant did do was rely on soda pop to keep him fuelled throughout the day; frequent stops to fast-food restaurants were also part of his daily routine.

?That was our demise,? says Judy Wilkie of the all-too-common combination of sugary soda drinks and prepared foods. ?There is too much fructose and sugar everywhere, it?s one of the big reasons why there are so many more people today being diagnosed.?

His last years of struggle were in stark contrast to the vibrant life Jim Wilkie lived for 66 years.

?He was such a beautiful person, so full of heart and energy,? says Wilkie of the man she fell in love with when she was just 16 years old.

Jim, who was 20, was in the military and had just moved to Calgary from Nova Scotia to train at Canadian Forces Base Calgary (the base was closed in 1998). The pair met at a house party just a few blocks from the base as he was preparing for a tour in Cyprus.

?From that moment on, we were in our own world together,? says Judy, adding that they eloped to Moscow, Idaho, when she turned 18. ?My parents wanted me to marry a lawyer, not a soldier,? she says with a chuckle.

The young couple settled in southwest Calgary, where Judy juggled a successful catering business with raising two active boys.

When he wasn?t busy with his job at Coca-Cola, Jim played football with his boys and golf with his best friends. Son Bob took to the game of hockey, playing for the Detroit Red Wings and Philadelphia Flyers.

?We had the ultimate lifestyle,? says Judy of those years. ?Life was so good.?

Things began to change as Jim entered his mid-50s. He started feeling lethargic, experiencing occasional numbness in his feet. At his wife?s urging, he finally went to a doctor. ?It?s such a silent disease, so internal,? says Judy. ?The doctor told him he had high blood pressure and that the diabetes had already done a lot of damage.?

Over the next decade, Jim?s condition would steadily worsen. After years of infections and mobility issues, he woke up one morning to find his left foot had turned black. ?He had a toe and a piece of foot amputated,? says Judy.

That crisis would be followed by ever more serious ones. He had his right leg amputated just below the knee; his condition was also resulting in troubles with both his eyesight and hearing.

?Then his kidneys gave out,? says Judy, who then accepted the offer by their son Bob to move her and Jim into the country home he shared with his wife and two kids. ?He needed dialysis three times a week.?

Spending the past two years in their eldest son?s home, with a view of the Rockies and everyday contact with the grandkids, says Judy, ?was the greatest gift we could have received.?

This past August, Jim?s condition worsened to the point he had to be hospitalized. ?We decided to start videotaping his story,? she says.

Once she gets through her first Christmas without her beloved husband, Judy says she plans to start a non-profit organization called Sweet Ripple of Change, with a website that will include a blog, information on resources for diabetics and Jim?s final videos.

?Our experience will be lived by millions of people,? she says of the videos that include heartbreaking descriptions by her husband about the trauma of losing a limb.

?I hope we can create the same kind of awareness about diabetes as others have done about smoking.?

Conn. shooting site draws hundreds of visitors

NEWTOWN, Conn. (AP) ? The Sandy Hook section of Newtown was a gathering place this weekend for hundreds of people drawn to the scene of the recent massacre to share in the community's mourning and come to terms with the shocking school tragedy.

The village's downtown was clogged with traffic Sunday, with license plates from all across New England and beyond.

Residents across Newtown, meanwhile, were seeking to move forward through faith, community and a determination to seize their future. Many have taken advantage of counseling services.

Both groups are trying in their own way to cope with the puzzling Dec. 14 massacre at Sandy Hook Elementary School that took the lives of 20 children and six adults. Police say the gunman killed his mother before heading to the school and committed suicide afterward.

People with bouquets of flowers, teddy bears and cameras walked along the closed road to the makeshift memorial near the school. Mark Burkhart brought his wife and daughter from Wingdale, N.Y., to pay their respects.

"We felt we had to come here to grieve a little bit," he said. "You find yourself not sure what to do or what to say, so this kind of helps."

Connor Collier, 21, of Newtown, said visitors earlier in the week were mostly with the media. But that changed during the weekend to "just regular people" from as far away as Washington State and Florida.

"Frankly, I like this a lot better. Everybody wants to help," said Collier, who has spent the past week near the village Christmas tree selling green and white bracelets that read, "Angels of Sandy Hook." He said he has raised $40,000 for a fund established for the victims.

A man dressed as Santa greeted visitors Sunday while a group of saxophone players from Newtown High School serenaded the crowd with Christmas carols.

Anne Spillane, 51, of Sandy Hook, drove some of the band members, including her daughter. She said the brother of one band member was killed in the shooting. He was one of several victims the Sillane family knew.

She said she and others in town have been buoyed by the outpouring of support.

A family that lives about three hours away in New Bedford, Mass., came Saturday with a life-sized Santa Claus that held a scroll with the names of all the victims engraved on it, Sillane said.

And a police officer from New Britain gave her a box of homemade Christmas ornaments with the names of each victim on them, Sillane said.

"I gave those to our monsignor, and he's going to give them to the families," she said. "People are just so good. We understand. They just want to do something."

At religious services in Newtown on Sunday, parishioners recognized their church leaders for helping them to cope with the shooting deaths.

After the Sunday service at Newtown's Trinity Episcopal Church, the Rev. Kathleen Adams-Shepherd received hugs and kisses from a long line of parishioners. She choked up as she read the names of the victims and offered a prayer for all of them, including gunman Adam Lanza and his slain mother, Nancy.

Monsignor Robert Weiss of the St. Rose of Lima Roman Catholic Church thanked the community for giving him strength to get through a week filled with funerals. St. Rose of Lima lost eight children and two adults in the massacre.

"This has been the worst week of my life," Weiss said.

Deacon Rick Scinto of St. Rose of Lima said church officials will be teamed with professional counselors and therapists to provide assistance.

"I don't see us taking a lead role, but I certainly see us taking a cooperative role in any kind of counseling that they need. We have our niche. We're religious and we can talk about God and how the Lord figures in this whole mess," Scinto said.

To deal with the short-term trauma, the state sent dozens of mental health professionals to Newtown. Sessions were available every day, at a half-dozen locations. Relief also has been provided by therapy and service dogs, massage therapists, acupuncturists and art therapists, from around Connecticut and the nation.

Dennis Stratford, who works for the school district, happened to be making a delivery to Sandy Hook Elementary when the gunman attacked. He saw dead children. He saw the remains of dead children on those who survived. He waited agonizing minutes for his own child to emerge unharmed from the school. Two of his neighbors' children did not.

"I go home and cry every night, and I cry every morning," Stratford said.

He went to one counseling session, but the horrific images remain. What helps more is work: sorting through the warehouses full of gifts, delivering them where they need to go or doing whatever else needs to be done for his town.

"There were nine minutes of evil, and an infinity of goodness after that," Stratford said, sitting on a forklift loaded with gifts. "This is therapy for me."

Self Improvement And Empowerment Blog: Turn Fear Into Love ...

If you look around you, there are fear messages all around you. The news is saturated with fear messages and most conversations tend to revolve around some form of fear. With fear being in the main stream, it can be challenging and you can even get weary if you're trying to hold the light when no one else seems to be doing that around you.

I get it. I've seen angels since I was a child. I read people's energies and know things about them that they may never understand. I've brought bugs back to life when they were squooshed and it seemed there was no hope for them with my healing gift. I've fought for my right to just feel what I feel without being told I'm crazy or too sensitive and in the process of it all I have lost myself many times, fallen and scraped my knees more times than I can count, lived on the streets, I have been beaten and still I wondered why no one else felt the things that I did deep in my soul.

One word. FEAR.

Everyone is emotionally sensitive. Everyone has spiritual gifts. Everyone can tap into their inner wisdom, the light, God, Infinite Spirit and be in the flow of manifesting what they desire. Many have lost their way.

They've been told to be a certain way. Boys have been told not to cry, to tough it out and macho up. Girls have been told "Shhhh... that's not very lady like" and this still happens because I see it every day. Over the years people have been placed into categories, held up to expectations by others, told they were bad, given tools for war rather than tools for peace and love and now we live in a world where people are struggling to feel love, struggling to feel happy and struggling to get through tough times.

So let's bring in some light. You may identify with some part of this. I wanted to be transparent because there is a gift in my rich past experience and I know that. I would be selfish not to share it with you so I share it with the intention that it spark some light within you.

How to turn fear into love.

First of all you must be willing to buck the crowd at times. Not everyone is going to get the light right away. Some may go away and others may take a while to come around. It's not about them. It's about YOU claiming your right to light and to living your life from that place. That means getting up and sending light to the people in your home, at work, at the store and doing everything you do in the light.

Create a practice that will help you tune into more love and light in your heart. Meditate, journal, read spiritual books, join a spiritual group, hire a mentor who can hold the space for you and practice saturating yourself in lighter thought forms, lighter feelings, lighter perceptions. The heavier stuff will start to fall away.

Face the fears about being in the light and thinking you'll be rejected. When you release rejection and the fears around BEING YOU for all that you are then a cellular change begins to take place. Energetically you begin to shift into a different way of being. You'll naturally be in harmony with the world around you and resistance, challenges and obstacles will start to disappear.

You have a right to be the light. In fact it is your spiritual responsibility to everyone on this planet. Fear has only created pain, separation and war. Only love and light will remove fear from your life.

You owe it to yourself, your family and the rest of the world to finally drop your story, drop the fear, drop the pain, drop the drama and claim today that you will begin to write a new story that will fulfill you, heal you, nurture you, support you and in turn spread to those around you.

8 New Etiquette Rules for Using Gadgets in the Office

As the use of personal technology increases at work, it's important to observe some new etiquette rules about how we use it. Here are eight of the most important rules to follow at work when it comes to cell phones, email, and other modern technology.

1. Using speaker phone when others can hear you. Playing back your voicemail messages on speaker phone or conducting an entire call on speaker phone is distracting to people trying to work around you. Even if you're in an office with the door closed, speakerphone noises tend to travel. Don't value your hands-free convenience over the ability of others to focus on their work.

2. Keeping your cell phone out so you can glance at it during meetings. Glancing down at your phone while you're supposed to be focused on a meeting signals that you're bored, not fully engaged, or don't respect the time of the people you're meeting with. If you must keep your phone out because you're expecting an important call or text, explain that at the start of the meeting so that people don't assume you're just being rude.

3. Don't overuse "reply all." When multiple people are included on an email chain, they don't all need to see your reply of "thanks" or "will do." Only use "reply all" if everyone included truly needs to see your response; otherwise, stick with "reply" so your response goes only to the sender and doesn't clutter multiple in-boxes.

4. Don't email and phone with the same message; pick one or the other. Nothing is more annoying than starting to read an email, only to have the email's sender pop his head in your office to repeat the same message.

5. Turn off your cell phone's ringer if you leave it behind while you're away from your desk. Ask any office worker, and you'll hear stories about the annoying guy who leaves his phone behind with his ringer on full-volume while he goes to meetings ... leaving his co-workers forced to hear repeated renditions of "Who Let the Dogs Out" or whatever else he's chosen for his ringtone.

6. Placing calls from a noisy location. If you make a call, ensure you're somewhere where you and the person you're speaking with will be able to hear each other--and where you can give your full focus. It's irritating to get a call from someone who immediately puts you on hold to order coffee because she just reached the front of the line.

7. Keep religious and political messages out of your email signature. Including religious or political messages is likely to offend or at least irritate some of your recipients, and introduces topics that don't belong in a professional setting. Keep your sign-off neutral and professional.

8. Don't use your work email as your personal email. In most offices, sending occasional personal emails from your work account is fine, but you should use your personal account for most personal things. If you treat your work email as your default personal account, chances are good that when you leave your job and your inbox and sent folder are full of personal messages, one of your co-workers will be stuck reading through all of them, as they clean out your account for your replacement. In the best case scenario, that's merely a nuisance for a co-worker --but in the worst case scenario, it could lead to embarrassing revelations.

Django Unchained Movie Review | Film School Rejects

DJANGO UNCHAINED

Quentin Tarantino has very quickly, but not so quietly, found a new niche for his filmmaking talents as a teller of tall tales with a historical bent. He?s less interested in historical accuracy than he is historical tomfoolery, but that never lessens the sheer entertainment he finds in mankind?s relatively recent foibles and misdeeds. From Inglourious Basterds? band of World War II Nazi-killers to his latest film?s vengeful slave turned bounty hunter, Tarantino has shown a knack for fitting his charismatic and electric characters into unexpected historical contexts with entertaining as hell results.

It?s 1858 in America, and Dr. King Schultz (Christoph Waltz) is a dentist on a mission. It?s light on tooth decay, heavy on bloodshed and utterly unrelated to the field of dentistry. He?s a bounty hunter whose latest targets, The Brittle Brothers, present a challenge in that he has no idea what they look like. Undeterred, Schultz acquires, apprentices and befriends a slave named Django (Jamie Foxx) who can identify the brothers. In exchange the ex-dentist will help the newly freed Django reunite with his wife, Broomhilda (Kerry Washington), who currently belongs to a cruel but undeniably charming plantation owner named Calvin Candie (Leonardo DiCaprio).

What follows is a tale that would have made American History class a hell of a lot more memorable as Schultz and Django cut a bloody swath across the post-Civil War South through racists, enforcers and recognizable TV actors (Tom Wopat! Lee Horsley!) from decades past. The cinematic violence is paired with Tarantino?s typically sharp and often hilarious dialogue, an eclectic and anachronistic soundtrack and a roster of actors as thrilled to be onscreen as viewers will be watching them. Despite its subject matter Django Unchained is a somewhat slighter film than its predecessor and sometimes feels too comically broad and bloated, but as with David Fincher and the Coen brothers even Tarantino?s lesser films often exceed the best that others have to offer.

Schultz and Django work their way through a handful of wanted men, and while some of it is accomplished via montage and time lapse we?re shown Django?s entry into the business by way of the Brittle Brothers in vibrant detail. They?re tracked to Big Daddy?s (Don Johnson) plantation, a bright and faux-happy land that a racist, meat-eating incarnation of Colonel Sanders would be happy to call home. The laughs are plentiful, but when the violence comes it?s with the brutal crack of a whip and the generous spurting of dark red blood (done practically as opposed to via CGI).

Two of Tarantino?s biggest strengths have always been his scripts and his casts so it?s no surprise that both are highlights again here. Script-wise the film boasts some brilliant and eminently quotable dialogue that shies away from punch lines as infrequently as it does the n-word. It?s laugh out loud funny, but while it (unsurprisingly) finds much to exploit in the world of slavery, lynchings and casual murder it still allows for some serious and harsh exchanges and instances. It?s most definitely not for the squeamish.

All three leads give fine and fun performances and truly embrace their characters with enthusiasm. Waltz gets many of the best lines and proves again how wonderfully suited he is for Tarantino?s words. Foxx does well too as he manages the tightrope between the solemnity of the subject matter and the playfulness of the execution. If there?s a stand out though it?s DiCaprio?s turn as the malicious and easily offended Candie. Subtlety is not an option and DiCaprio lets his inner evil loose with a mustache-twirling, scene-stealing performance that refuses to let the fun stray too far from the cruelty. The supporting cast is equally memorable with appearances by Walter Goggins, Franco Nero, Michael Parks, James Remar (twice!) and others. Last but not least, Samuel L Jackson plays the film?s darkest bad guy (pun not intended) as Candie?s well-treated house servant who turns other slaves in for severe punishment at the drop of an N-bomb.

As entertaining as it is though, the film is a step back from the multi-layered high of Inglourious Basterds. While that film has loads of surface level entertainment it also features a smart subtext on movies and movie-making that runs parallel to its tale of Nazi scalping and familial revenge. Django is all surface by comparison. Clearly there?s a none too subtle criticism of slavery and racism, but that?s more common sense than commentary.

It also has pacing issues most notable when Tarantino brings the movie to a stirring, crimson-colored conclusion only to let it keep going for another twenty-five odd minutes. Prior to the film?s natural end there?s only one scene that probably should have hit the cutting room floor (even if it is a very funny ode to Blazing Saddles), but this near thirty minutes of extra ending marks the first time that the film begins to feel long. There?s a temptation to blame the absence of his longtime editor Sally Menke, but it?s clear the excess is all due to Tarantino. The section contains laughs and thrills to be sure, but it still feels unnecessary.

Still, not every film needs to be a masterpiece (self-declared or otherwise). Sometimes ?damn good? is more than good enough.

The Upside: Very funny; violence is often ridiculous and wonderfully bloody; actors are having an infectiously great time; damn nice seeing amble blood squibs used instead of CGI

The Downside: Runs twenty or so minutes too long; comedy often feels too broad; lacks additional subtext; subterfuge used against Mr. Candie seems wholly unnecessary and illogical; someone needs to tell Tarantino that his cameos are his films? low point

On the Side: The role of Django was originally intended for Will Smith, but the actor decided to make After Earth with M. Night Shyamalan instead, so everyone be sure to send a Thank You note to Mr. Shyamalan

Cancer Immunotherapy Where Are We Going?

The compelling concept of utilizing the patient?s own immune system for a stronger and more effective way to attack cancer cells is not a new one. William Coley observed in 1891 that infections produced in patients with inoperable cancer following an injection of streptococcal organisms (Gram-positive bacteria) led to tumor shrinkage especially when the patients developed fever and other signs of a full-blown infection.1 Since then, research has embraced approaches to ?train? the patient?s own immune system to recognize certain biomarkers or proteins that are mainly found on cancer cells and to destroy the cells.

After several setbacks the first cellular immunotherapy, Dendreon?s Sipuleucel-T (Provenge?), was approved for the treatment of prostate cancer in 2010. Today, new promising cancer immunotherapy approaches are in clinical trials. Most recently, researchers at the 54th American Society of Hematology (ASH) meeting reported early success with a developmental-stage cell-based cancer vaccine for the treatment of leukemia and have shown remission in several patients 2,3, including a 7-year old girl who relapsed twice after chemotherapy.

Cancer immunotherapy can be thought of as either active or passive immunotherapy. The most prominent passive immunotherapies, which have revolutionized cancer therapy, are monoclonal antibodies that either target tumor-specific antigens and receptors or block important pathways central to tumor growth and survival. Therapeutic monoclonal antibodies are the market leader in the targeted cancer therapy space and include blockbusters such as trastuzumab (Herceptin?) or rituximab (Rituxan?).

In general, antibodies are significant elements of the body?s adaptive immune system. They play a dominant role in the recognition of foreign antigens and the stimulation of the immune response. Therapeutic antibodies target and bind to antigens, usually proteins that are mainly expressed on diseased cells such as cancer cells. After binding, cancer cells can be destroyed by different mechanisms such as antibody-dependent cellular cytotoxicity, the activation of the complement system ? an important part of the immune system ? and triggering cell death.

Although very successful, especially in oncology, therapeutic antibodies have a significant limitation: they don?t generate a memory response by the immune system, and thus, repeated antibody infusions are required. Further, monoclonal antibodies are only able to recognize specific proteins present of the cell surface. Monoclonal antibodies are mostly produced in cell culture systems which are often costly. Humanization of murine monoclonal antibodies by replacing of certain parts of the antibody with human sequences has improved the tolerability of antibodies and made them less immunogenic, but even fully human sequence-derived antibodies can carry some immunological risk.

Novel approaches in the passive immunization strategy include antibody drug conjugates, a combination of targeting antibody with a very potent drug such as the recently approved brentuximab vedotin (ADCETRIS?) for Hodgkin lymphoma and anaplastic large cell lymphoma (ALCL). ADCETRIS comprises an anti-CD30 monoclonal antibodyanti-CD30 monoclonal antibody and a cytotoxic (cell-killing) agent that is released upon internalization into CD30-expressing tumor cells. Currently, the development of next generations of ADCs is underway.

Alternatively, specific and durable cancer immunotherapies designed to actively ?train? or stimulate the patient?s intrinsic immune response have been more problematic; however, recent success stories, such as the cell-based immunotherapy Provenge, have revitalized this field. Dendreon?s approach modifies the patients? own dendritic cells to present a protein specific to prostate cancer cells.

Dendritic cells are the most potent, ?professional? antigen-presenting cells. They process the antigen material and present it on their surface to other cells of the immune system. Once activated, the dendritic cells migrate to the lymphoid tissues where they interact with T-cells and B-cells ? white blood cells and important components of the immune system ? to initiate and shape the adaptive immune response. To develop Provenge, each patient?s own dendritic cells are harvested and then loaded ex vivo with the tumor-associated antigen. Now ?presenting? the antigen, the dendritic cells are administered back into the patient to induce a potent, cell-mediated anticancer immune response resulting in tumor shrinkage and clinical benefit.

In another experimental approach for the treatment of leukemia, patients? own modified T-cells were infused back into the patients. Prior to this, the T-cells were transduced with a lentivirus to express the CD19-specific chimeric antigen receptor. CD19 is an antigen which is found on B-cell neoplasms, cancerous B-cells, and the lentivirus was the vehicle to transfer the genetic material for CD19 into the cells.? A case report published in the New England Journal of Medicine stated that a patient with chronic lymphocytic leukemia (CLL) was in ongoing remission 10 months after treatment.3

These promising results have spurred continued research for new and safe ways to achieve effective tumor vaccination, and drug developers have explored many cancer immunotherapy strategies. To generate an effective antitumor immunity, therapeutic intervention should drive several functions; specifically, it should promote the antigen presentation functions of dendritic cells, promote the production of protective T-cell responses, stimulate B-cells and overcome immunosuppression characteristics that are common to tumor cells.4

Cell-based therapeutic vaccines are most frequently produced outside the patient?s body and involve isolation of the specific cells, such as dendritic cells, and the introduction of preselected antigens, often with the use of specific vehicle, into the cells. The antigens can be encoded in viral vectors (frequently DNA) or administered as peptides or proteins in a suitable adjuvant and carrier through a long and cumbersome process.

During my doctoral thesis, I conducted immunization experiments using RNA as a negative control, assuming that the RNA would be degraded during the experiment thus making it impossible to use as a vaccine. The physiological role of messenger (m) RNA is to transfer genetic information from the nucleus to the cytoplasm where this information is translated into the corresponding protein. mRNA is known to be very unstable and has a relatively short half-life. But astonishingly, we were able to measure a solid T-cell immune response. We repeated the experiment and confirmed that the RNA we had produced had the potential to be used as a vaccine. Importantly, we didn?t need to isolate the patients? cells: mRNA-based vaccines can be injected directly into the skin (intradermal). The mRNA-based vaccines are then taken up by antigen-presenting cells, such as dendritic cells, and are then able to induce an immune response. Importantly, mRNA-vaccines can also be synthesized quickly for any antigen sequence identified.5

The first mRNA-based vaccines (RNActive?) are now in the clinic for the treatment of prostate cancer and lung cancer and have demonstrated that they do what they are supposed to do ? induce a balanced humoral, as well as T cell-mediated, immune response that is entirely HLA independent. The HLA (human leukocyte antigen) system is used to differentiate the body?s own cells (self) and non-self cells. Additionally, RNA-vaccines do not need a vehicle such as a virus for delivery to the cells, nor do they contain virus-derived elements that are often found in DNA-vaccines. These attributes make RNActive a very safe therapeutic.

The risk of integration of the RNA into the host-genome is minimized (RNA would have been transcribed first to DNA, and then it has to be transported to the nucleus), as is the residual risk of DNA-based vaccines for inactivating or activating genes or affecting cellular regulatory elements, which can induce oncogenesis. Thus, the favorable safety profile of mRNA-based therapies broadens their potential use not only for the treatment of diseases but for use as prophylactic vaccinations. A recent proof-of-concept study using mRNA-based vaccines (RNActive) in animal models for influenza was published in Nature Biotechnology.6

Therapeutic cancer immunotherapies and vaccines have come a long way, and novel, promising approaches give hope for safe and effective treatment options. This may one day lead to the treatment of all cancers as chronic diseases.
